Understanding the AI Literacy Obligation
The EU AI Act (Regulation (EU) 2024/1689) is the world's first comprehensive legislative framework for artificial intelligence. While much attention has focused on the Act's risk-based classification system and the requirements for high-risk AI systems, one of the earliest obligations to take effect is the AI literacy requirement under Article 4. This provision has been in effect since 2 February 2025, well before the majority of the Act's other provisions. It requires all providers and deployers of AI systems, regardless of the risk level of those systems, to take measures to ensure that their staff and other persons dealing with AI on their behalf have a sufficient level of AI literacy.
The concept of AI literacy under the Act encompasses the skills, knowledge, and understanding that allow providers, deployers, and affected persons to make informed decisions about AI systems. This includes understanding the basics of how AI works, the potential for biases and errors, the ability to critically evaluate AI outputs, and awareness of the rights and obligations created by the AI Act. The level of literacy required is not one-size-fits-all; it should be proportionate to the context, the technical complexity of the AI systems used, and the role and responsibilities of the individuals concerned.
Who Is Affected by the AI Literacy Obligation?
The AI literacy obligation casts a very wide net. It applies to providers of AI systems (companies that develop or place AI systems on the market), deployers of AI systems (companies that use AI systems in a professional capacity), and extends to all personnel who interact with AI systems in the course of their work. This means that a company using an AI-powered customer service chatbot, an AI-driven recruitment screening tool, a machine learning model for financial risk assessment, or even a general-purpose AI assistant like those based on large language models would need to ensure that the employees who use or manage these systems have appropriate AI literacy.
The obligation applies to organizations operating in or serving the EU market, following the same territorial scope as the broader AI Act. This means non-EU companies that provide AI systems for use in the EU or deploy AI systems that affect persons in the EU are also covered. The breadth of this obligation means that virtually every organization that uses modern digital tools involving any form of AI or machine learning should consider whether the AI literacy requirement applies to them and take steps to ensure compliance.
EU AI Act Implementation Timeline
The AI literacy obligation (Article 4) has been in effect since 2 February 2025, but the EU AI Act is being implemented in phases. The next major milestone is 2 August 2025, when obligations for general-purpose AI (GPAI) model providers take effect and national competent authorities must be designated. On 2 August 2026, the high-risk AI requirements under Annex III become applicable along with transparency obligations for certain AI systems. Finally, on 2 August 2027, high-risk AI systems embedded in products covered by existing EU product safety legislation (Annex II) must comply. Organizations should prepare now for each upcoming phase that affects their operations.
What Training Is Required?
The AI Act does not prescribe a specific training curriculum or certification for AI literacy. Instead, it takes a principles-based approach, requiring organizations to assess the literacy needs of their staff based on their roles, the AI systems they interact with, and the context in which those systems are used. For a marketing team using AI-powered analytics tools, literacy might focus on understanding data biases, limitations of algorithmic recommendations, and responsible interpretation of AI-generated insights. For a development team building AI systems, literacy would encompass a much deeper understanding of model training, testing, bias mitigation, and technical documentation requirements.
Organizations should consider developing a structured AI literacy programme that includes foundational training for all staff who interact with AI systems, role-specific training for those in more technical or decision-making positions, regular updates as AI technology and regulation evolve, and documentation of training activities to demonstrate compliance. While formal certification is not required, keeping records of training programmes, attendance, and content is advisable as evidence of compliance in the event of a regulatory inquiry.
