Who Needs Product Liability
Anyone in the supply chain: manufacturers, importers, distributors, wholesalers, retailers, private-label brands. Even if a contract manufacturer made the product, your name on the package puts you in the lawsuit. Amazon, Walmart, Target, and most major retailers require $1M-$2M product liability proof before allowing you to sell.
How 2027 Premiums Are Priced
Three main inputs: product type (apparel cheap, supplements expensive), annual sales volume (premium scales near-linear), and distribution channel (Amazon and DTC carry slight surcharge for lawsuit exposure). Imported goods cost 15-30% more — foreign manufacturers are often judgment-proof, so US carriers price for the assumption that you're the only deep pocket.
Coverage Gaps To Watch For
Product recall is usually sub-limited or excluded — buy First-Party Product Recall coverage separately for $250K-$5M. Failure-to-warn claims may need a separate sub-limit. Pollution from products (CBD oils, supplements) often excluded — get a pollution endorsement. Foreign jurisdiction — selling in Canada, EU, or Australia may require worldwide coverage. Audit your policy for these every renewal.
Common Product Liability Mistakes
(1) Relying on the manufacturer's policy — "named insured" is the manufacturer, not your brand. You need your own policy. (2) Skipping foreign-supplier coverage — if the maker is in China, US courts treat YOU as the deep pocket. (3) Excluding product recall — recall expenses can dwarf liability claims ($100K-$5M) and require separate First-Party Product Recall coverage. (4) Failing to add additional insureds — major retailers (Amazon, Walmart, Target) require to be listed as Additional Insured. Missing this = account suspension on Amazon, lost contract elsewhere.
