Most states require 'substantial' or 'material' change in circumstances since original order. Disability, retirement, remarriage of recipient, cohabitation of recipient all count as substantial.
Cohabitation Termination
30+ states allow alimony termination upon recipient cohabitation with romantic partner. Some require proof of financial commingling. Others require living together 90+ days. Florida: 30 days continuous cohabitation. California: presumption after 6 months. Documentation: shared lease, joint bills, sworn statements from witnesses.
Retirement And Modification
Retirement at full retirement age (65-67) supports modification petition. Reduction not automatic — court considers (1) was retirement voluntary or forced, (2) is income reduction genuine, (3) recipient's needs. Standard outcome: 25-50% reduction tied to actual income drop. Mandatory retirement (military, federal) gets more generous treatment.
