Strict Liability vs One-Bite Rule
Strict liability states impose owner liability for dog bites regardless of the dog's history — California, Florida, Illinois, New York (in most cases), Michigan, New Jersey, and most states. Easy recovery: prove the bite happened and you weren't trespassing/provoking.
One-bite rule states (Texas, Mississippi, and partial application in some others) require the plaintiff to prove the dog had prior aggression and the owner knew about it. Much harder case — usually requires neighbor testimony, prior incident reports, or vet records.

Damage Categories
Economic damages: medical bills (ER, surgery, follow-up), future medical (scar revision, plastic surgery, PT), lost wages (time off work to recover), and property damage if any.
Non-economic damages: pain and suffering, emotional distress, PTSD, disfigurement, loss of enjoyment of life. Calculated using a multiplier (1.5x to 7x economic damages) based on injury severity. Severe scarring on visible areas (face, hands) commands higher multipliers.
Insurance and Recovery
Most dog bite claims are paid by the owner's homeowner's insurance — average payout 2023 was $58,545 per the Insurance Information Institute. Some homeowner policies exclude certain breeds (pit bulls, rottweilers, mastiffs, dobermans) or all dogs after a prior bite incident.
If the owner has no insurance or assets, recovery may be limited. Some states permit recovery against landlords if they knew about the dog's danger. Cyclists, pedestrians, and delivery workers often have personal liability coverage that includes dog bite to others (rarely).
Settlement Value Drivers
Higher value: injuries to children (sympathy + future trauma), permanent scarring on visible areas, multiple surgeries, PTSD diagnosed by therapist, disfigurement requiring plastic surgery, infection (rabies, MRSA), large/aggressive breed (pit bull, rottweiler).
Lower value: minor punctures, no scarring, quick recovery, victim was trespassing or provoking. Most cases settle pre-trial within 6-18 months. Hire a personal injury attorney — they work on contingency (33% standard) and typically increase settlement 2-3x vs unrepresented claimants.
