GDPR Article 83 Fine 2027 Calculator
GDPR Article 83 sets two maximum levels for administrative fines. Article 83(4): up to €10,000,000 or, for an undertaking, up to 2% of total worldwide annual turnover of the preceding financial year, whichever is higher. Article 83(5) and (6): up to €20,000,000 or up to 4%, whichever is higher. This calculator shows that legal maximum. It does not estimate the fine an authority would actually impose.
The Two Levels in Article 83
Article 83(4): infringements of the listed provisions are subject to administrative fines up to €10,000,000, or in the case of an undertaking, up to 2% of the total worldwide annual turnover of the preceding financial year, whichever is higher. Article 83(5): for the provisions listed there, up to €20,000,000 or up to 4%, whichever is higher. Article 83(6) applies the same higher level to non-compliance with an order of the supervisory authority.
How the Maximum Is Worked Out
For an undertaking, compare the fixed amount with the percentage of worldwide turnover and take the higher figure. With €50 million turnover, 4% is €2 million, so the Article 83(5) maximum is €20 million. With €1 billion turnover, 4% is €40 million, so the maximum is €40 million. The percentage becomes the higher figure once turnover exceeds €500 million.
Why No "Likely Fine" Is Shown
Article 83(2) requires the authority to give due regard to the circumstances of each case, including the nature, gravity and duration of the infringement, whether it was intentional or negligent, action taken to mitigate damage, and cooperation with the authority. There is no formula in the Regulation that converts those factors into a percentage, so this page does not invent one.
