Enforceability Requirements

Both parties need: (1) independent legal counsel — single-attorney prenups commonly challenged, (2) full financial disclosure — hiding assets voids the agreement, (3) reasonable terms — extremely one-sided agreements get struck down, (4) execution well before wedding (30+ days) — last-minute agreements signed under duress are invalidated.

Postnup vs Prenup

Postnuptial agreements are signed after marriage. Same enforceability requirements but face higher court scrutiny because marriage itself is consideration. Common reasons for postnup: business sale, inheritance, infidelity discovery, post-marriage asset acquisition. Cost is similar to prenup ($2K-$10K range).
