Rideshare Injury Settlement Calculator (Uber & Lyft)
Uber and Lyft maintain $1 million third-party liability coverage when the driver is en route to or carrying a passenger. Rideshare settlements average 1.5-4x medical bills depending on injury severity, fault assignment, and state caps.
Three Rideshare Insurance Phases
Phase 1 (driver app off): personal auto policy only — $25-100K state minimums. Phase 2 (app on, awaiting ping): Uber/Lyft contingent $50K bodily injury per person. Phase 3 (en route to passenger or carrying): full $1 million third-party liability. Knowing which phase the accident occurred in determines available recovery.
Pain and Suffering Multiplier Bands
Insurance adjusters apply a multiplier to economic damages. Minor soft tissue (whiplash, no permanent damage): 1.5-2x. Moderate (sprain, short-term care): 2.5-3x. Significant (surgery, extended recovery): 3.5-4x. Severe (permanent disability, disfigurement, brain injury): 5x and up. Multiplier is the single biggest swing factor in settlement size.
Comparative Fault State Rules
States vary: Pure comparative (CA, NY) — recover proportional to fault, even 99% at fault. Modified 50% bar (CO, ME) — barred above 50% fault. Modified 51% bar (TX, IL) — barred at 51%. Pure contributory (AL, MD, NC, VA, DC) — barred even at 1% fault. Calculate fault carefully — it's the second biggest swing.
