NHL Subtype and Tier Assignment
Highest tier: diffuse large B-cell lymphoma (DLBCL), follicular lymphoma. Mid tier: marginal zone lymphoma, mantle cell, B-cell NHL not otherwise specified. Lower tier: chronic lymphocytic leukemia / small lymphocytic lymphoma (CLL/SLL) — Bayer disputes the link. Multiple myeloma cases were excluded from earlier settlements but new MM litigation is active. T-cell lymphoma claims are weaker (less epidemiological support).
Exposure Tiers
Tier A — occupational applicators (groundskeepers, farmers, landscapers) with 5+ years use: highest awards. Tier B — heavy residential/lawn users (1-5 acres maintained personally) 5+ years: mid. Tier C — light/occasional residential use: lowest. Documented purchase receipts, employer records, and lifetime-pesticide-use diary (EPA-style) boost the case. Confounders that reduce awards: heavy alcohol, hepatitis C, HIV, family history of NHL, organ transplant.
Statute of Limitations and Settlement Timing
Most states: 2-3 years from diagnosis date (CA = 2, NY = 3, TX = 2, FL = 4 for products liability with discovery rule). Multidistrict Litigation (MDL 2741) is still accepting cases as of 2025; new state-court filings continue. Master settlement payouts arrive in 4-12 months after enrollment. Litigation through trial takes 2-3 years.
