Three Components of SSDI Back Pay
Back pay covers: (1) Retroactive — up to 12 months before your application date, IF you were disabled then. (2) Past-due — application date to approval date. (3) Ongoing monthly benefit starts the month after approval. The 5-month waiting period (from Established Onset Date) is excluded from all back pay calculations.
Why Average Back Pay Is $20-30K
Average adjudication time: 7-12 months for initial decision, 18-24 months including reconsideration and ALJ hearing. Most claims win at ALJ level (45-50% approval). Attorney Fees Are Capped By SSA
SSA caps attorney fees at the lesser of 25% of back pay or $7,200 (raised from $6,000 in November 2024). Attorney is paid directly by SSA from back pay before you receive it.
