Who Qualifies — Diagnosis and Use
Ovarian cancer claimants: documented epithelial ovarian, fallopian tube, or primary peritoneal cancer, with use of J&J Baby Powder, Shower-to-Shower, or other J&J talc-containing products in the perineal area for ≥4 years cumulative. Mesothelioma claimants: pleural or peritoneal mesothelioma plus documented talc exposure. Confounders that reduce awards: BRCA1/2 mutation, family history of ovarian cancer, asbestos workplace exposure (for ovarian only — boosts mesothelioma).
Litigate or Accept the Plan?
Plan payouts arrive 12-24 months after confirmation but cap at tier ceiling. Litigation can yield 5-10x for severe cases (e.g. the 2018 Ingham $4.69B Missouri verdict for 22 ovarian-cancer plaintiffs, reduced to $2.1B on appeal) but takes 2-4 years and risks defense verdict (J&J wins ~30% at trial). Lung cancer talc cases are weak. Mesothelioma cases tend to settle for $1M-$5M individually outside the plan.
Statute of Limitations
Product liability SOL runs 2-4 years from diagnosis in most states under the discovery rule (CA = 2 yr, NY = 3 yr, TX = 2 yr, NJ = 2 yr — important because J&J's HQ-state). Wrongful death: 1-2 years from death. Bankruptcy bar date (when confirmed) supersedes state SOL for claims filed against the trust — verify the bar-date order.
