Malaysia property stamp duty consists of two parts: Memorandum of Transfer (MOT) duty on the purchase price, and Loan Agreement duty on the mortgage amount. Both are payable to LHDN (Inland Revenue) at the time of property transfer. First-time Malaysian buyers of residential property up to RM500,000 receive 100% exemption on both; RM500,001 to RM1,000,000 gets 75% off MOT.

MOT — Progressive Rates by Purchase Band

Memorandum of Transfer duty escalates by price band: 1% on the first RM100,000; 2% on RM100,001 to RM500,000; 3% on RM500,001 to RM1,000,000; 4% above RM1,000,000. For a RM700,000 property: RM1,000 (first band) + RM8,000 (second band) + RM6,000 (third band) = RM15,000 MOT. The progressive structure encourages first-home affordability and taxes luxury upgrades. Sub-sale (second-hand) and direct-developer (new-build) attract the same MOT — there is no reduced rate for new builds in Malaysia.

Loan Agreement Duty — Mortgage Stamp

Stamp duty on the Loan Agreement is a flat 0.5% of the loan amount (not the property price). For a RM400,000 loan, duty = RM2,000. Lower loan-to-value ratios reduce this duty proportionally. Refinancing also triggers Loan Agreement duty — factor this into refi cost-benefit before deciding. Cash buyers (no mortgage) skip this duty entirely.

First-Time Buyer Exemptions and Budget 2026 Changes

Budget 2026 extended the full exemption (100% off MOT + Loan duty) for residential properties up to RM500,000 purchased by first-time Malaysian buyers. From RM500,001 to RM1,000,000, MOT gets 75% off. Above RM1,000,000 full rate applies. Commercial property does not qualify for exemption.
