“Child” here means a son or daughter, or the children of a son or daughter who died earlier. Fixed shares are paid first. Whatever is left, the remainder, goes to the residuary heirs: sons first (with daughters at half a son's share), then the father, then full brothers and sisters.
Worked examples
A man leaves a wife, two sons and a daughter. The wife takes 1/8. The remaining 7/8 is split into five parts, two for each son and one for the daughter: each son gets 7/20 and the daughter 7/40. On ৳40,00,000 that is ৳5,00,000 for the wife, ৳14,00,000 for each son and ৳7,00,000 for the daughter.
A woman leaves a husband, a father and a mother. The husband takes 1/2. The mother takes one-third of what remains, 1/6, and the father the rest, 1/3.
A man leaves a wife and one daughter, no other heir listed here. The wife takes 1/8 and the daughter 1/2. The leftover 3/8 has no residuary to go to, so it returns to the daughter: she ends with 7/8.
Before the shares: what comes out of the estate first
Heirs divide only what is left after four things, in this order: funeral and burial costs; the debts of the person who died, including unpaid dower (mohor) owed to a wife; any gift made by will, which cannot exceed one-third of what remains and cannot favour an heir without the other heirs' consent; and then the heirs' shares. Grandchildren whose parent died first
Under classical rules a grandchild is excluded when the deceased has a living son. Bangladesh changed this by statute. Section 4 of the Muslim Family Laws Ordinance, 1961 gives the children of a son or daughter who died before the deceased the share their parent would have received if alive. The calculator counts each such branch as that son or daughter; the branch then divides its share among its own children, a boy taking twice a girl's portion.
Awl and radd
Sometimes the fixed shares add up to more than the whole. A woman leaving a husband (1/2), two full sisters (2/3) and a mother (1/6) is the standard case: the total is 8/6. Every share is then reduced in the same proportion, which is called awl, giving 3/8, 4/8 and 1/8. When the opposite happens and part of the estate is left with no residuary heir, the remainder is returned to the sharers in proportion, called radd. The spouse does not take part in radd while another sharer exists.
Limits and next steps
Heirs can agree among themselves to divide differently after the shares are fixed, and a living owner can give property by hiba (gift) during his or her lifetime; neither is modelled here.
